Trident Shell LLC provides cybersecurity services including penetration testing, red team operations, and cloud security assessments. The specific scope, timeline, and deliverables for each engagement are defined in a separate written agreement.
Information on our website is for general purposes only. It is not a guarantee of specific results or outcomes.
3. Engagement Agreements
Each engagement is governed by a separate Statement of Work (SOW) or service agreement signed by both parties. That agreement will define:
- Scope of testing and systems involved
- Timeline and milestones
- Fees and payment terms
- Rules of engagement
- Reporting and deliverables
If there is a conflict between these Terms of Service and a signed engagement agreement, the engagement agreement controls.
4. Authorization
By engaging our services, you confirm that you have the legal authority to authorize security testing on all systems included in the scope of work. You are responsible for obtaining any required permissions from third parties, such as hosting providers or cloud vendors, before testing begins.
Trident Shell will not perform testing without written authorization. We reserve the right to pause or stop work if we believe proper authorization has not been obtained.
5. Confidentiality
We treat all engagement data, findings, and reports as confidential. We will not share your information with third parties unless required by law or authorized by you in writing.
This includes vulnerabilities discovered, network details, system configurations, and any other data gathered during an assessment. Confidentiality obligations survive the end of the engagement.
6. Limitation of Liability
Security testing, by its nature, involves interacting with live systems. While we take care to minimize disruption, there is always some risk that testing could cause service interruptions or unexpected behavior.
To the fullest extent permitted by law, Trident Shell's total liability for any claims arising from our services is limited to the fees you paid for the specific engagement in question.
We are not liable for indirect, incidental, or consequential damages, including lost revenue, data loss, or business interruption, arising from our services.
7. Intellectual Property
Once full payment is received, you own the assessment reports and deliverables produced for your engagement. You may use them internally or share them as you see fit.
Our testing tools, methodologies, techniques, and general knowledge remain the property of Trident Shell. We may reuse our methods and approaches across engagements.
8. Indemnification
You agree to indemnify and hold Trident Shell harmless from any claims, damages, or expenses arising from:
- Your failure to obtain proper authorization for testing
- Your misuse of assessment reports or findings
- Any breach of your obligations under the engagement agreement
9. Governing Law
These terms are governed by the laws of the State of Maryland. Any disputes will be resolved in the courts of Maryland.
